Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of the Terms of Service between you and Ubik, Inc., a Delaware corporation headquartered in New York, New York ("Ubik," "we," "us," or "our"). It describes what you may not do when using the Ubik platform, desktop application, APIs, and related services (collectively, the "Service"). Violation of this AUP may result in content removal, account suspension, or account termination.
1. Prohibited Content
You may not use the Service to create, store, process, or distribute:
Illegal content, including child sexual abuse material (which we are required to report to authorities), non-consensual intimate imagery (including synthetic or AI-generated), content facilitating human trafficking or terrorism, and instructions for manufacturing illegal drugs, explosives, or weapons of mass destruction.
Harmful content, including malware, viruses, or other malicious code; phishing materials; content designed to harass, threaten, stalk, or doxx individuals; hate speech that promotes violence against any group based on protected characteristics; and deliberately false information intended to deceive at scale.
Deceptive content, including fraudulent documents, forged credentials, or fake identification; content impersonating another person or organization without disclosure; fabricated reviews, testimonials, or endorsements; and academic work intended for submission as another person's original work.
2. Prohibited Activities
Service abuse. You may not circumvent rate limits, quotas, or access controls; create multiple accounts to exceed free-tier limits; share login credentials with unauthorized users; make excessive automated requests designed to degrade the Service; resell access to the Service without authorization; or use the Service for cryptocurrency mining.
Security violations. You may not attempt unauthorized access to accounts, systems, or data; probe for vulnerabilities outside of our responsible disclosure program; distribute malware through the Service; intercept communications or access data not intended for you; or disable or circumvent security features.
Intellectual property violations. You may not upload content you do not have the right to use; use trademarks in a misleading manner; process trade secrets improperly; or distribute copyrighted material without authorization. See our DMCA and Copyright Policy for copyright-specific procedures.
Privacy violations. You may not process personal data in violation of applicable privacy laws; collect personal information without appropriate consent; use the Service to track or surveil individuals without authorization; or attempt to re-identify individuals from anonymized datasets.
Spam and manipulation. You may not use the Service to generate bulk unsolicited communications, automated social media engagement, content produced solely for search engine manipulation, artificial traffic or click fraud, or fake reviews or ratings.
3. AI-Specific Restrictions
You may not use the Service's AI features for weapons development or targeting systems; mass surveillance or building facial recognition databases; systems that discriminate based on protected characteristics in employment, lending, housing, or other legally regulated contexts; psychological manipulation at scale; autonomous control of critical infrastructure without human oversight; or generating content intended to deceive without disclosure of AI involvement.
When required by law, regulation, platform rules, or professional standards, you must disclose that content was created with AI assistance and must not represent AI-generated content as solely human-authored.
For high-risk applications such as healthcare, legal, financial, or safety-critical decisions, AI output must be reviewed by qualified professionals before being relied upon.
4. Enforcement
We may detect violations through automated content analysis, user reports, manual review, and legal process. When we identify a potential violation, we investigate, notify you when practicable and not prohibited by law, and take action proportionate to the severity: warnings and content removal for minor violations; temporary suspension for moderate violations; account termination for severe violations; and immediate termination with reporting to law enforcement for critical violations such as CSAM or imminent threats of violence.
We consider the severity and nature of the violation, whether the conduct was intentional, the user's history of compliance, the impact on others, and the user's cooperation with our investigation.
5. Appeals
If you believe an enforcement action was taken in error, you may submit an appeal to info@ubik.studio within 30 days of the action, with the subject line "AUP Appeal." Include a description of the action taken, your explanation, and any supporting evidence. We will acknowledge your appeal within two business days and issue a decision within 10 business days. Appeal decisions are final.
6. Reporting Violations
To report content or activity that violates this AUP, email abuse@ubik.studio with a description of the violation, the location of the content (URLs, usernames, project names), and any supporting evidence. Reports are treated confidentially. Filing false or malicious reports may result in action against the reporting account.
7. Mandatory Reporting
We report child sexual abuse material to the National Center for Missing and Exploited Children as required by law. We report imminent threats of violence and terrorism-related content to appropriate law enforcement authorities. We comply with valid subpoenas, court orders, and government requests issued through proper legal process.
8. Changes
We may update this AUP to address new forms of abuse, comply with new laws, or clarify existing rules. Material changes are communicated through our Terms of Service notification procedures.
