DMCA and Copyright Policy

Ubik, Inc., a Delaware corporation headquartered in New York, New York ("Ubik," "we," "us," or "our"), respects intellectual property rights and complies with the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"). This policy explains how to report copyright infringement on the Ubik platform and how we process claims.
1. Reporting Copyright Infringement
If you believe that material available through the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
(a) A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
(b) Identification of the copyrighted work claimed to be infringed, or, if multiple works are covered, a representative list.
(c) Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it, such as URLs or descriptions.
(d) Your name, address, telephone number, and email address.
(e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
(f) A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid notice, we will act expeditiously to remove or disable access to the material and will notify the user who posted it.
2. Counter-Notification
If you believe your content was removed due to mistake or misidentification, you may submit a counter-notification to dmca@ubik.studio containing:
(a) Your physical or electronic signature.
(b) Identification of the material that was removed and the location where it appeared before removal.
(c) A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
(d) Your name, address, telephone number, and email address.
(e) A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which Ubik may be found), and that you will accept service of process from the person who provided the original notice or that person's agent.
If the original complainant does not notify us of a court action within 10 to 14 business days after we forward the counter-notification, we will restore the removed material.
3. Repeat Infringer Policy
We terminate the accounts of users who are the subject of repeated valid DMCA takedown notices. Serious or willful infringement may result in immediate account termination.
4. AI-Generated Content
Users are responsible for ensuring that AI-generated content created through the Service does not infringe third-party copyrights. AI output may inadvertently resemble copyrighted works. If you believe that AI-generated content on the Service infringes your copyright, submit a standard DMCA notice as described in Section 1.
5. Misuse Warning
Filing a knowingly false DMCA notice constitutes perjury under 17 U.S.C. Section 512(f) and may expose you to liability for damages, including attorneys' fees. We may decline to process future notices from parties who have submitted fraudulent claims.
6. Non-Copyright Claims
The DMCA process applies only to copyright infringement. For trademark, trade secret, defamation, or privacy-related complaints, contact info@ubik.studio.
7. International Copyright
While the DMCA is United States law, we respond to valid copyright takedown requests from any jurisdiction. For claims under the EU Copyright Directive, UK Copyright, Designs and Patents Act, or other national copyright laws, contact dmca@ubik.studio.
